Public-Private Partnership

Our law firm offers consulting services during a company's process of selecting the most adequate model of public-private partnership, while taking into account all required resolutions and acts; and we also carry out projects in public-private partnership.
The Public-Private Partnership Act draws a line between two forms of conducting a public-private partnership, the contractual partnership and status partnership. 

A contractual partnership can take a form of:

  • A concession-based relationship; or
  • A relationship based on public procurements.

Status partnership, also called institutional or equity partnership, is achieved  by:

  • The creation of a legal entity,
  • The sale of a public partner’s share(s) in a public company or other legal entity active under public or private law,
  • The buying of a share in a legal entity active under public or private law,

Public-private partnerships are mainly formed to engage in investment into public projects or public co-financing of private projects, especially in the following areas:

  • Projects carried out by public utility companies.
  • Public infrastructure construction, financing, architectural design, construction, control, organization, as well as management and maintenance.
  • Projects carried out by other public utility companies or entities active in similar economic fields which are crucial to public interest.
